Terms of Service

1. Acceptance of Terms
By accessing or using Stampool ("the Service"), operated by Stampool Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. Description of Service
Stampool provides an NFC-powered digital loyalty stamp platform for local businesses. Merchants use NFC stamps to reward repeat customers. Customers collect stamps and redeem rewards through the platform.
3. Merchant Accounts
- You must provide accurate business information during registration.
- You are responsible for maintaining the security of your account credentials.
- You must not share NFC stamp devices with unauthorized parties.
- Lost or stolen NFC stamps must be reported immediately for deactivation.
4. Customer Usage
- Customers interact with the Service by tapping NFC stamps at participating merchants.
- A valid phone number is required for stamp collection and reward redemption.
- Attempting to collect stamps without a legitimate in-store visit is prohibited.
- Reward codes are single-use and expire as specified at time of issuance.
5. Payments and Billing
Merchant subscriptions are billed monthly based on registered customer count. All prices are in Canadian dollars (CAD) and subject to Ontario HST (13%). You may cancel your subscription at any time; access continues until the end of the current billing period.
6. Prohibited Use
- Reverse engineering, tampering with, or cloning NFC stamp URLs.
- Automated or scripted access to stamp collection endpoints.
- Using the Service for any unlawful purpose.
- Impersonating another merchant or customer.
7. Intellectual Property
All content, trademarks, and technology comprising the Service are owned by Stampool Inc. You may not reproduce, distribute, or create derivative works without our written permission.
8. Limitation of Liability
To the maximum extent permitted by law, Stampool Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Merchants may export their data within 30 days of termination.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
11. Changes to Terms
We may update these Terms from time to time. We will notify active merchants via email at least 30 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.
